Can I rent out my home?
Yes. Name and contact information of renters must be forwarded to Associa. Please notify Associa when tenants are no longer residing at your home. If a property management company is overseeing the rental, you must provide their contact information as well. Landlords are to ensure that all renters follow basic governing documents such as HOA policies and regulations. Landlords are responsible for the non-compliance of their renters.
Landlords need to ensure that renters conduct proper maintenance of landscaping, understand protocol for trash & recycle bins, provide proper access through use of gate codes & openers, follow street parking protocol and all other relevant policies per the CC&Rs.
How do I handle the presence of wildlife in my yard/neighborhood?
The homes in our community are situated in a natural desert environment. We are surrounded by an abundance of wildlife, which are protected by both local and state regulations. While some wildlife can be troublesome, it is part of their natural environment and the HOA cautions homeowners from both harming and feeding wildlife. It is against AZ law to feed any animals in Pima County, with the exception of birds.
Residents with pets should be cautious about leaving pets in areas where wildlife can interact. Please see the Wildlife Guide for Homeowners for additional information.
Are there specific rules if I put my home up for sale?
The Gallery HOA has established the following rules for Open Houses which are consistent with state statutes. One temporary industry standard "open house" sign will be allowed at the location of the open house. No other superfluous or excessive "attention seeking" items are allowed.
Agents must be present during the open house.
The hours for open houses per the State Statute are from 8:00am - 6:00pm daily.
Agents cannot publish gate codes in their MLS listing, advertising or at the entrance.
The public should call the agent to obtain the access code for entrance into the Community for the open house.
Modern and reasonable For Sale signs provided by the realtor should be used.
Can I display flags and political signs?
Flags may be displayed in a homeowners front or backyard, per AZ Statute 33-1808. No more than two flags may be displayed at one time and the size of each flag may not exceed 3ft x 5ft. See Design Guidelines Section 3.39 and Appendix E for regulations on Flags.
In accordance with AZ 33-1808, the Gallery Association has adopted the following regulations regarding the display of Political Signs and flags:
Signs may only be displayed on Owners Lots. No signs may be placed in the Gallery Association’s Common Areas.
Signs may be placed no earlier than seventy-one (71) days before a primary election and must be removed no later than fifteen (15) days after the general election. A sign for a candidate in a primary election who does not advance to the general election, must be removed within fifteen (15) days after the primary election.
There is no limit on the number of political signs or flags that may be displayed in the above time period, but shall not exceed nine (9) square feet or the maximum aggregate total dimensions allowed by the Town of Marana.
